Who Can File a Wrongful Death Claim?
Those who can make a wrongful death claim include a decedent’s immediate family or estate representatives. Immediate family typically includes spouses, children, siblings, and parents. In Illinois, those who can make a wrongful death claim is determined by the Wrongful Death Act. 740 ILCS 180
Is There a Statute of Limitations for Wrongful Death Claims?
According to Illinois law, a decedent’s family or representative must make a wrongful death claim within two years of the incident. However, there are exceptions. The period may be extended if the at-fault party engaged in a violent criminal act. In these cases, the statute of limitations is five years after the incident or one year after the conclusion of criminal court proceedings.
